Understanding More About The Whistleblower Act

by Tonia Michael

In order to reprimand companies for breaking laws and causing harm to the public, the Whistleblower Act was initiated. It is designed to encourage employees of these businesses to report violations that have occurred, so they may protect themselves and the public. The law also protects these employees from repercussions that could be carried out by their employers.

Fraudulent and criminal activity by corporations and other business have gone on for years. Many of these activities have resulted in physical and financial harm done to the public, and people such as financial investors and employees. When a company operates in this way, the damage can be extremely severe extensive.

Within these businesses there may be many employees who are aware of these practices and disagree with them. Some of these employees might feel the need to expose these acts, but are reluctant to do so due to the retaliation they may endure the company. In the past, those employees who have come forward have been fired, or reprimanded immediately in some other fashion.

In order to protect those persons coming forth to expose the truth, the Whistleblower Act has been implemented. In addition to protecting, it also encourages others to help stop any unethical or shady business practices that occur. Since this law has been enacted, more and more employees have taken advantage of it. Most would not have done so, due to the fact they could easily be fired for their actions.

Since the law has been implemented, states have been allowed to modify it, and apply additional limitations and variations to it. Pennsylvania, for instance, only allowed employees of public organizations to receive protection. This protection has been extended to workers of private organizations, if these organizations receive funding from the public.

By doing a service to the public and exposing their company's illegal practices, employees are offered legal protection. Legal protection is given in case companies decide to exercise any legal options they have available. What these employees are doing is a great thing, and authorities would like to reward them for doing so. Aside from legal protection, they will receive monetary aid to supplement any monies lost due to termination.

A claim cannot be filed arbitrarily for any other reason than for legitimate purposes. If you attempt to be a whistleblower, you must be sure you have a sound and meaningful reason for suggesting any wrongdoing by your employer. If no proper evidence can be found to help your case, it will likely be abandoned. This is done to avoid fighting companies that do nothing wrong. Some employees, in the past, have filed claims solely because they were fired, or because they were upset about something else.

The Whistleblower Act is a vital tool set in place to expose companies and their illegal business tactics. It allows employees to come forward and provide the much needed information to pursue legal action. This law allows these persons to participate, and gives them protection for doing so. Whether they are aware of it or not, they are doing a great service to the public. The entire process helps the public and investors stay safe.
